٢٨٣ - باب تحريم التعذيب بالنار في كل حيوان حتى النملة ونحوها

On the authority of Abū Hurayrah (may Allah be pleased with him), who said: The Messenger of Allah (ﷺ) sent us on a military expedition and said: "If you find so-and-so and so-and-so" — naming two men of Quraysh — "then burn them both with fire." Then, when we were about to set out, the Messenger of Allah (ﷺ) said: "I had ordered you to burn so-and-so and so-and-so, but none punishes with fire except Allah; so if you find them, kill them." Al-Bukhārī narrated it.

And on the authority of Ibn Masʿūd (may Allah be pleased with him), who said: We were with the Messenger of Allah (ﷺ) on a journey, and he went off to relieve himself. We saw a ḥummarah (a small sparrow-like bird) with two chicks, and we took its two chicks. The ḥummarah came and began beating its wings in distress. The Prophet (ﷺ) came and said: "Who has distressed this bird over its young? Return its young to it." And he saw an ants' colony that we had burned, and he said: "Who burned this?" We said: "We did." He said: "It is not fitting that any should punish with fire except the Lord of the Fire." Abū Dāwūd narrated it with a sound chain. His saying «qaryat naml» (an ants' colony) means: the dwelling-place of the ants together with the ants.
