٣٦٦ - باب النهي عن صمت يوم إلى الليل

From ʿAlī (may Allah be pleased with him), who said: I memorised from the Messenger of Allah (peace and blessings be upon him): «There is no orphanhood after a nocturnal emission, nor ritual silence for a day until the night.» It was narrated by Abū Dāwūd with a chain that is good (ḥasan). Al-Khaṭṭābī said in his commentary on this hadith: ritual silence was among the rites of the pre-Islamic era. In Islam they were forbidden from that and were commanded with remembrance and speaking of good.

From Qays ibn Abī Ḥāzim, who said: Abū Bakr al-Ṣiddīq (may Allah be pleased with him) entered upon a woman of Aḥmas called Zaynab, and found her not speaking. He said: «What is the matter with her that she does not speak?» They said: She has performed ḥajj in ritual silence. He said to her: «Speak, for this is not lawful; this is from the practice of the pre-Islamic era.» So she spoke. Recorded by al-Bukhārī.
