ذوذوPossessor ofContextual gloss

Distant kindred (dhū ’l-raḥm): every relative who is neither a fixed sharer nor a residuary; they are four categories. The first: children of daughters and children of sons’ daughters, however low [in descent].

The second: eliminated grandfathers and eliminated grandmothers, however high [in ascent].

والجدّوالجدّAnd the grandfatherContextual gloss

The eliminated grandfather: every grandfather between whom and the deceased is a mother.

The eliminated grandmother: every grandmother between whom and the deceased is a male between two females.

The third: daughters of brothers unrestrictedly, children of sisters unrestrictedly, and sons of uterine brothers.

The fourth: the deceased’s paternal aunts and his maternal uncles and maternal aunts unrestrictedly, and his paternal uncles through the mother and their daughters unrestrictedly.

They do not inherit except when the deceased has no fixed sharer apart from husband or wife, and no residuary.

The first category is given precedence, then the second, then the third, then the fourth.

ومتىومتىAnd wheneverContextual gloss

Whenever a male and female of one category meet and are equal in degree and line, the property is divided between them {for the male the like of the portion of two females}; and if only one of them exists, he or she takes the whole estate.
