ويَحِلّAnd lawful is توسّدهusing it as a pillow والنومand sleep عليهon it لهما،for both of them, بخلافunlike اللِّحاف.the blanket.
Using [silk] as a pillow and sleeping on it is lawful for them both—unlike a blanket.
Section — Wearing silk and qazz is permissible for women, not for men, even if they are fighters, except for a silk emblem or fabric woven with gold to the breadth of four fingers
ويَحِلّAnd lawful is توسّدهusing it as a pillow والنومand sleep عليهon it لهما،for both of them, بخلافunlike اللِّحاف.the blanket.
Using [silk] as a pillow and sleeping on it is lawful for them both—unlike a blanket.
ويَحِلّAnd lawful is تعليقhanging سترةٍa curtain علىon البابِthe door للحاجة.for need.
Hanging a curtain on the door for need is lawful.
ويحرمAnd unlawful is تِكَّةbelt-buckle adornment (tikkah) الحريرof silk والديباجand dibāj ولِبْنتها.and its pouch.
Silk brocade belts (tikkah) of silk and dibāj and their pouches are unlawful.
ويَحِلّAnd lawful is لبْسwearing ماwhat سداهits warp حريرٌsilk مطلقاً،absolutely, وماand what لحمتهits weft carried حريرٌsilk يَحِلّlawful فيin الحربِwar خاصّة.only.
Wearing what has silk as warp is lawful without restriction; what has silk as weft is lawful in war only.
ولاAnd not يَحِلّlawful للرّجالfor men منof الذهبgold شيء.anything.
Nothing of gold is lawful for men.
ويَحِلّAnd lawful لهمfor them منfrom الفضة:silver: الخاتم،the ring, والمِنطقة،the belt buckle, وحليةand ornament [of] السيف.the sword.
For them from silver are lawful: the ring, the belt buckle and sword ornaments.
والتختمAnd wearing a ring [made] بالحجرِof stone والحديدِiron والصفرِand brass حرامٌunlawful للرَّجالfor men والنِّساء،and women; والمعتبرand what is considered الحلقةthe band فيجوزso it is permitted كونfor الفصّthe bezel حجراً،to be stone, ويَجعلand places الرَّجلthe man الفَصَّthe bezel إلىtowards باطنinside كَفِّه.of his palm.
Wearing a ring of stone, iron or brass is unlawful for men and women; what counts is the band, so the bezel may be stone. The man should turn the bezel towards the inside of his palm.
والأفضلAnd better لغيرfor other than القاضيthe judge والسّلطانand the ruler ممَّنof whoever لاnot يَحتاجneeds إلىto الختمthe seal تركه،to leave it, ولاand not يتجاوزexceeds وزنهits weight مثقالاً.a mithqāl.
It is better for one who is not a judge or ruler and does not need a seal to leave it off, and its weight should not exceed one mithqāl.
ولاAnd not يشَدّbind السنّthe tooth المتحرِّكloose بالذَّهب،with gold, بلbut بالفضّة،with silver, ولوand if قطعwas cut off أَنْفهhis nose أوor سَقَطَfell out سنّهhis tooth عوَّضَهreplace for him بفضّة،with silver, فإنthen if انتنَit putrefied عوَّضهreplace for him بذهب.with gold.
A loose tooth should not be bound with gold but with silver; if one’s nose is cut off or a tooth falls out it is replaced with silver; if it putrefies it is replaced with gold.
ويَحْرمAnd unlawful is إلباسdressing الصبيانِboys [in] الذهبَgold والحريرَ،and silk, والإثمand the sin علىupon الملْبس.the one who clothes.
Dressing boys in gold and silk is unlawful; the sin lies on the one who clothes them.
ويَحْرمAnd unlawful is حملcarrying المنديلthe handkerchief تكبّراً،out of arrogance, ويَحِلّand lawful لمسحwiping العرقsweat وبَلَلand moisture الوضوءof ablution والمخاطand mucus ونحوها،and their like, كالتربّعsuch as crossing the legs يَحِلّlawful للحاجة،for need, ويحرمand unlawful تكبّراً.out of arrogance.
Carrying a handkerchief out of arrogance is unlawful; wiping sweat, moisture of ablution and mucus and the like is lawful; crossing the legs is lawful for need and unlawful out of arrogance.
ويَحِلّAnd lawful is ربطtying الرّتيمة.the ratīmah.
Tying the ratīmah (forelock loop) is lawful.
ويحرمAnd unlawful is النظرlooking إلىto غيرِother than الوجهِthe face والكفّينand the two hands منof الحرَّةthe free woman الأَجنبية،unrelated, وفيand concerning القدمthe foot روايتان،two reports, فإنthen if خافَhe feared الشهوةَdesire لمnot ينظرْlet him look إلىto الوجهِthe face أيضاًeither إلاexcept لحاجة،for need, وكذاlikewise لوif شكّ.doubt.
Looking at other than the face and hands of an unrelated free woman is unlawful; there are two reports about the foot. If he fears desire he should not look at the face either except for need; likewise if in doubt.
ولاAnd not يَحِلّlawful للشابّfor the young man مسّtouching الوجهthe face والكفينand the two hands وإنeven if أَمِنَhe was safe الشهوة،from desire, إلاexcept منfrom عجوزan old woman لاnot تشتهى،desired, فتَحِلّthen lawful المصافحةhandshaking ونحوها،and the like, وكذاlikewise لوif كانhe was شيخاًan elder وأَمِنَand safe عليهon him وعليها،and on her, فإنthen if خافhe feared عليهاfor her حَرم.forbidden.
A young man may not touch her face and hands even if safe from desire, except an old woman who is not desired—then handshaking and the like are lawful; likewise if he is an elder and safe on his and her account; if he fears for her it is forbidden.
والصغيرةAnd the small girl التيwho لاnot تشْتَهىis desired يَحِلّlawful مَسّها.touching her.
Touching a small girl who is not [of an age] to be desired is lawful.
ويَحِلّAnd lawful للقاضيfor the judge عندwhen الحكم،judgement, وللشّاهدand for the witness عندwhen الأداءtestifying خاصّة،specifically, وللخاطبand for the suitor النظرlooking معwith خوفfear الشهوة،of desire, ولكنbut يقصدintends بهthereby الحكم،judgement, والشهادة،testimony, وإقامةand upholding السّنةof the Sunna بقدرaccording to الإمكان،ability, لاnot قضاءfulfilling شهوة.desire.
The judge may look when giving judgement, the witness when testifying specifically, and the suitor may look with fear of desire—but he must intend thereby judgement, testimony and upholding the Sunna as far as possible, not satisfying desire.
ويَحِلّAnd lawful للطبيبِfor the physician النظرَlooking إلىto موضعِthe site المرضِof illness منهاfrom her إنif لمnot يمكنهpossible for him تعليمinstructing امرأةٍ،a woman, ثمَّthen يسترhe covers ماwhat وراءَbeyond موضعِthe site المرض،of illness, وينظرand looks ويغضّand lowers بصرَهhis gaze ماwhat استطاع،he was able, وكذاlikewise الخافضةthe midwife والخاتنand the circumciser والحاقن.and one giving enema.
The physician may look at the site of her illness if he cannot instruct a woman; then he covers what lies beyond the site of illness, looks and lowers his gaze as much as possible; likewise the midwife, circumciser and one giving enema.
وينظرAnd looks الرجلthe man منfrom الرجلthe man إلىat جميعall بدنهhis body إلاexcept عورته،his ʿawrah (nakedness), ويمسّand he touches ماwhat ينظرhe looks إليه.at.
A man may look at another man’s whole body except his ʿawrah (nakedness), and may touch what he may look at.
وتنظرAnd looks المرأةthe woman منfrom المرأةِthe woman إلىat ماwhat ينظرlooks الرجلthe man إليهat it منfrom الرجل.the man.
A woman may look at a woman to the extent a man may look at a man.
وينظرAnd looks منof أمتهhis slave girl التيwho تَحِلّlawful لهto him وزوجتهand his wife إلىat جميعِall بدنها.of her body.
He may look at his female slave who is lawful to him and his wife at their whole bodies.
وينظرAnd looks منof محارمهِhis unmarriageable kin إلىat ماwhat وراءbeyond البطنِthe belly والظهرِthe back والفخذ.and the thigh.
He may look at his unmarriageable kin at what is beyond the belly, the back and the thigh.
والمحرم:And the maḥram: كلّevery منof whom يَحْرمforbidden نكاحهاher marriage علىupon التأبيدpermanently بنسبٍ،by kinship, أوor رضاعٍ،breastfeeding, أوor صهريةaffinity [through marriage], ولوeven if أنهاshe بزنا.through fornication.
The unmarriageable kin (maḥram): everyone with whom her marriage is permanently forbidden by blood, breastfeeding or affinity—even if through fornication.
ويمسّAnd touching ذلكthat أيضاً،also, فإنthen if خافhe feared عليهfor him أوor عليهاfor her لمnot ينظرlet him look ولمand not يمس،touch, ولاand no بأسharm بالخلوةin privacy بها،with her, والسفرand travel معها.with her.
Touching in that case too [is allowed]; if he fears for himself or her he should neither look nor touch. There is no harm in privacy with her or travelling with her.
وينظرAnd looks منof أمةِslave girl [of] غيرِهanother إذاwhen أَمِنَhe was safe الشهوةَfrom desire إلىat ماwhat ينظرhe looks إليهat it منof محارمه،unmarriageable kin, ولوeven if كانتshe was أمّmother [of] ولد،a child, أوor مكاتبة،mukātabah, أوor مدبَّرةmudabbirah أوor مستسعاة،mustasʿāh, وفيand concerning الخلوةِprivacy بهاwith her والسفرand travel معهاwith her قولان،two opinions, ويَحِلّand lawful لهfor him مسّtouching ذلكthat وقتtime [of] الشراءpurchase وإنeven if خافhe feared الشهوة،desire, وقيل:and it was said: يَحِلّlawful لهfor him النظرlooking وقتtime [of] الشراءpurchase معwith خوفfear الشهوة،of desire, ولاand not يَحِلّlawful المسّtouching معه.with that.
He may look at another’s slave girl when safe from desire to what he may look at of unmarriageable kin—even if she is a mother of his child, mukātabah, mudabbirah or mustasʿāh; there are two opinions on privacy and travel with her. Touching that at the time of purchase is lawful even if he fears desire; it was said looking at purchase time with fear of desire is lawful, touching is not lawful with that.
والخَصِيّAnd the castrated والمجبوبand the severed والمخنَّثand the effeminate كالفحلِlike the virile man فيin حكمِruling [of] النظرِlooking والمسّ.and touching.
The castrated, the severed and the effeminate are like an able man in the ruling of looking and touching.
والعبدAnd the slave كالأجنبيِّlike the stranger فيin رؤيةِviewing سيِّدته،his mistress, ويَحِلّand lawful لهfor him الدخولentering عليهاupon her منfrom غيرother than إذن.permission.
The slave is like a stranger in viewing his mistress, and he may enter upon her without permission.
ويعزلAnd he practises coitus interruptus عنwith أمتهhis slave girl بغيرwithout إذنها،her permission, وعنand with زوجتهhis wife الحرّةthe free بإذنها،with her permission, وعنand with زوجتهhis wife الأمةthe slave girl بإذنwith permission [of] مولاها.her owner.
He may practise coitus interruptus with his slave girl without her permission, with his free wife with her permission, and with his slave wife with her owner’s permission.
ويكرَهAnd disliked تقبيلkissing [of] الرجلthe man فمmouth [of] الرجلthe man ومعانقته،and embracing him, ولاand no بأسharm بالمصافحة،in handshaking, وقيل:and it was said: لاno بأسharm بهماin them both أيضاًalso إذاif قصدintended المبرةcourtesy والإكرام.and honour.
Kissing a man on the mouth and embracing him tightly are disliked; there is no harm in shaking hands; it was said there is no harm in those two as well if he intends courtesy and honour.
ولاAnd no بأسharm بتقبيلin kissing يدhand [of] العالمthe scholar والسلطانand the ruler العادل.just.
There is no harm in kissing the hand of a scholar or a just ruler.
