ولاAnd not يبدؤهمbegins against them الإمامthe Imām بقتالwith fighting حتىuntil يبدأواthey begin بهagainst him أوor يجتمعواgather له،for it, وعندthen at ذلكthat يقاتلهمfight them حتىuntil يفَرِّقَهم.disperses them.
The Imām does not begin fighting them until they begin against him or gather for it; then he fights them until he disperses them.
فإنSo if كانتwas لهمfor them فئةٌunit أَجهزfinish off علىupon جريحهمtheir wounded وأتبعand pursue موليهمtheir commander’s deserters وإلاّotherwise فلا.not.
If they have a unit he finishes off their wounded and pursues deserters of their commander; otherwise not.
ولاAnd not تسبىenslaved ذراريهم،their offspring, ولاnor تغنمtake as spoils أموالهم.their wealth.
Their dependants are not enslaved nor their wealth taken as spoils.
ويجوزAnd lawful القتالfighting بأسلحتهمwith their weapons وركوبand riding خيلهمtheir horses عندwhen الحاجة،need ويحبسand detains الإمامthe Imām أموالهمtheir wealth حتىuntil يتوبواthey repent فيردّهاthen returns it عليهم.to them.
Fighting with their weapons and riding their horses when necessary is lawful; the Imām seizes their wealth until they repent then returns it to them.
وماAnd what جبوهthey collected منfrom الزكاةzakāh والعشرand tithe والخراجand khārāj منfrom البَلادlands التيthat غلبواthey overcame عليهاupon them لمnot يثَن،doubled, ويفتىand fatwā is given المأخوذtaken منهfrom him, بإعادةwith repayment الزكاةzakāh والعشرand tithe إنif كانwere الآخذونcollectors أَغنياءwealthy بخلافunlike الخراج.khārāj.
What they collected as zakāh, tithe, and khārāj from lands they controlled is not levied twice; fatwā is given that the party from whom [payments] were taken should repay zakāh and tithe if the collectors were affluent—unlike khārāj.
ولوAnd if قتلkilled بعضهمsome of them بعضاً،others, ثمthen ظهرناwe prevailed عليهمupon them فهوso it is هدر،forfeit of blood, ولوand if غلبواthey overcame علىupon بلدtown فقتلthen killed رجلٌman منfrom أهلهits people رجلاًman آخرanother ثمّthen ظهرناwe prevailed علىupon البلدtown قبلbefore استقرارsettling ملكهمtheir rule وإجراءِand enforcing أَحكامهمtheir rulings وَجَبَobligatory القصاصretaliation وإلاّotherwise فهوso it is هدر.forfeit of blood.
If some of them kill one another and we prevail over them, no retaliation is due. If they conquer a town and a man of its people kills another man, then we conquer the town before their rule settles and their rulings take effect, retaliation is obligatory; otherwise no retaliation is due.
ولاAnd not يأثمsins العادلjust ولاnor يضمنliable بإتلافfor destroying مالwealth الباغيrebel أوor نفسه،his life, والباغيand rebel يأثمsins فيماin what يفعلdoes بالعادلto just ولاnor يضمن.liable.
The just party does not sin nor owe for destroying rebel wealth or life; the rebel sins for what he does to the just and owes nothing.
فلوSo if قتلَkilled العادلjust الباغيrebel وَرِثَه،inherits him, ولوand if قتلهkilled him الباغيrebel وقال:and said: قتلتهI killed him محقاًrightfully وَرِثَهinherits him وإنand if قال:said: قتلتI killed مبطلاًwrongfully لمnot يرثه،inherits him واللهand Allah أعلم.knows best.
If the just kills the rebel [the killer] inherits from him; if the rebel kills him claiming rightful killing [the rebel] inherits; if he says wrongful killing he does not inherit—Allah knows best.
